This is a translation of the French terms of sale; in the event of any discrepancy, the French version shall prevail.
1. Seller
These terms and conditions of sale apply to sales concluded on Convoyeur-Pneumatique.com between VIRTUAVIA SARL, SARL with share capital of 50 000 €, 2 rue Marcel Benoit, 38000 Grenoble, France, RCS Grenoble 428 797 450, VAT FR90428797450, phone +33 4 58 00 15 74, email contact@virtuavia.com (the “Seller”) and any person making a purchase (the “Customer”).
2. Scope
These terms apply to business customers (B2B) and consumers (B2C). Provisions specific to consumers are expressly indicated. Placing an order implies full acceptance of the terms in force on the day of the order, which the Customer acknowledges having read before confirming the purchase.
3. Products
The essential characteristics of the products (Venturi pneumatic conveyors and accessories) are presented on each product page. Photographs and drawings are illustrative; technical values are nominal values measured under standard conditions and may vary depending on the installation (pressure, air quality, hose length and diameter, material conveyed). Products are made to order.
The Customer is responsible for checking that the product is suitable for the intended application. The Seller may advise on the basis of the information provided; such advice does not relieve the Customer of validating integration into the installation. Unless expressly stated otherwise, products are not certified for use in explosive atmospheres (ATEX).
4. Prices
Prices are shown in euros excluding VAT and excluding shipping costs. Shipping costs, charged as a flat fee per order based on the delivery country, are shown before payment (see shipping and delivery) and are subject to VAT under the same rules. VAT is calculated at checkout according to the delivery country:
- delivery in France (and Monaco): French VAT at 20%;
- delivery to another EU Member State to a business with a valid EU VAT number: reverse charge, invoiced excluding VAT;
- delivery within the EU without a valid VAT number: French VAT;
- delivery outside the EU: VAT-exempt export; any customs duties, import taxes and clearance fees are payable by the recipient.
The applicable price is the one displayed when the order is confirmed. The Seller reserves the right to change its prices at any time.
5. Orders
The Customer selects the product and quantity, enters their details, checks the summary and confirms the order by paying. The order is binding once payment is confirmed; a confirmation email summarising the order is then sent to the Customer.
For large quantities or specific needs, the Customer may request a quotation via the quote form. The Seller reserves the right to refuse or cancel any order in the event of suspected fraud, previous dispute, obvious pricing error or impossibility of manufacture; the Customer is then refunded in full.
6. Payment
Payment is due on ordering. It is made online securely via our provider Stripe (card, Apple Pay, Google Pay, SEPA Direct Debit and other methods offered at checkout). Card data is encrypted and never passes through the Seller’s servers. See secure payment.
For orders on quotation, payment by bank transfer may be accepted. For business customers, any late payment automatically incurs penalties at three times the French statutory interest rate and a fixed recovery fee of €40.
7. Manufacturing and lead times
As products are made to order, the time between receipt of payment and dispatch is generally 1 to 2 weeks, plus transport time (see shipping and delivery). The Customer is informed of any significant delay. Consumers may cancel the order under the conditions of articles L216-6 et seq. of the French Consumer Code if delivery does not occur within the agreed time after formal notice.
8. Delivery and transfer of risk
Delivery is made to the address given by the Customer, who is responsible for its accuracy. For consumers, risk passes upon physical possession of the products. For business customers, risk passes when the products are handed over to the carrier.
The Customer must check the condition of the parcel on receipt and, in case of damage or missing items, record precise reservations with the carrier and inform the Seller as soon as possible.
9. Right of withdrawal (consumers only)
In accordance with articles L221-18 et seq. of the French Consumer Code, consumers have 14 days from receipt of the product to withdraw, without giving any reason. They notify their decision by email to contact@virtuavia.com or by post, for example using the form below, then return the product within 14 days of notification, complete and in its original condition, to: VIRTUAVIA SARL, 2 rue Marcel Benoit, 38000 Grenoble, France. Direct return costs are borne by the Customer.
The Seller refunds all sums paid, including initial delivery costs, within 14 days of the withdrawal notification, using the same payment method; the refund may be withheld until the product has been received or proof of its return has been supplied. The Customer may be liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the product.
The right of withdrawal does not apply to purchases made by businesses for their professional activity, nor to goods made to the Customer’s specifications or clearly personalised.
10. Legal warranties
Consumers benefit from the legal guarantee of conformity (articles L217-3 to L217-20 of the French Consumer Code) for two years from delivery, and from the guarantee against hidden defects (articles 1641 to 1649 of the French Civil Code).
For business customers, only the guarantee against hidden defects applies; it is limited, at the Seller’s option, to replacement or refund of products found to be defective. Warranties exclude defects resulting from abnormal use, non-compliant compressed air (wet, oily, unfiltered), pressure above 7 bar, normal abrasive wear or modification of the product.
11. Liability
For business customers, the Seller’s liability is limited to the amount of the order concerned and excludes indirect damage (loss of operation, production or turnover). Nothing in these terms limits the Seller’s liability towards consumers beyond what the law allows.
12. Personal data
The data collected is necessary to process the order and is handled in accordance with our privacy policy.
13. Complaints and mediation
Any complaint should first be sent to customer service: contact@virtuavia.com — +33 4 58 00 15 74. Consumers may refer the matter free of charge to the consumer mediator: VirtuavIa SARL , after a prior written complaint that has not been satisfactorily resolved.
14. Governing law and jurisdiction
These terms are governed by French law. For business customers, any dispute falls under the exclusive jurisdiction of the Commercial Court of Grenoble (France). Consumers may bring proceedings before the court of their place of residence.
